Terms of Sales

1. ACCEPTANCE OF GENERAL TERMS OF SALE

These General Terms of Sale contractually govern the commercial relationships between Abstract Lab and the customer of the website www.abstract-lab.art. By choosing to purchase products on www.abstract-lab.art, the customer expressly accepts the terms stated below. In the event of a contradiction between these general terms of sale and any other document on the site, including a quality charter or equivalent document, these general terms of sale prevail.

2. PRICES

The prices displayed on the website www.abstract-lab.art are in Euros, inclusive of all taxes, excluding shipping costs. Transactions are denominated in Euros. The price indicated in your order summary is the final price, including the total order amount, details of each product, and shipping costs. Abstract Lab reserves the right to modify the offerings on the www.abstract-lab.art site at any time in terms of products and prices, based on constraints related to suppliers. However, products will be invoiced based on the rates in effect at the time of order registration, subject to availability. In case of a manifest error in the price due to a typing mistake, Abstract Lab reserves the right to cancel the sale. An arrangement will then be proposed to the customer. Our sales are made with a reservation of ownership. The products remain the property of Abstract Lab until the full payment of the price.

3. ORDER

The customer can order online at www.abstract-lab.art. By clicking the “Confirm Order” button after the ordering process, you declare that you fully and unreservedly accept all these General Terms of Sale. The data recorded by Abstract Lab constitutes proof of all transactions between Abstract Lab and its customers. The data recorded by the payment system constitutes proof of financial transactions. Abstract Lab confirms to the customer the acknowledgment of the order by email to the address provided by the customer. In the case of payment by Credit Card, the sale is considered concluded only upon acceptance of payment by SP+, the secure payment system of Caisse d’Epargne, and confirmation of the order by Abstract Lab. Abstract Lab reserves the right to refuse or cancel any new order from a customer with whom a dispute exists. Furthermore, in the event of an issue related to order processing, Abstract Lab will contact the customer directly at the provided contact details to inform and propose a solution. When placing an order, the customer provides the following information under their sole and unique responsibility:

  • Email address
  • First and Last Name
  • Address
  • City
  • Postal Code
  • Phone
  • Fax In case of an error in the recipient’s address details, Abstract Lab cannot be held responsible for the impossibility of delivery, especially if the details are incomplete.

4. PRODUCTS

The products offered comply with current French legislation. They are produced and marketed by recognized manufacturers, under their own responsibility. Abstract Lab has complete independence in the selection of the products offered. The photographs of the products have no contractual value, nor does their precise weight or that of the packaging, which suppliers may change with the evolution of the range. Abstract Lab reserves the right at any time and without notice to add or remove products from its catalog.

5. PRODUCT AVAILABILITY

Our product offers are made within the limits of available stocks. For products not stored in our warehouses, our offers are valid subject to availability from our suppliers. In this context, information about the availability of products is provided when placing your order. This information is indicative as it comes directly from our suppliers. Errors or exceptional changes are beyond our control, and Abstract Lab cannot be held responsible. In the case of an order for a single item: unavailability of this item will result in an email notifying the customer of the out-of-stock situation and the restocking time. In the case of an order composed of multiple items: unavailability of one of the ordered items will result in an email notifying the customer of the out-of-stock situation and the restocking time for the missing item. Abstract Lab then reserves the right to split the delivery. Additional shipping costs that may be incurred by a split delivery will be covered by Abstract Lab.

6. DELIVERY ZONE, TIME, AND RATES

A – DELIVERY ZONE

Delivery is limited to the following areas:

  • Metropolitan France, Overseas Departments and Territories (DOM-TOM), and Corsica
  • Belgium, Switzerland, Luxembourg, Monaco, Andorra, Germany, Italy, Spain, Austria, Portugal, Bulgaria, Cyprus, Croatia, Denmark, Estonia, Finland, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Romania, United Kingdom, Czech Republic, Slovakia, Slovenia, Sweden Other countries or territories are excluded from the delivery zone.

B – ORDER PREPARATION

Between the order and shipment, the package preparation requires a period of 12 to 48 hours, depending on the time of order receipt for products stored at Abstract Lab, and up to 10 business days for products stored at suppliers. Orders are shipped or delivered to the customer only after the complete payment is received.

C- DELIVERY TIME

For metropolitan France, standard delivery times are 48 hours* after handing over the package to the courier company. For Corsica, Overseas Departments and Territories, and abroad, the period is 5 to 8 business days* *Information provided by carriers. To describe as accurately as possible the total time between order and delivery (order preparation + delivery time), the following conventions are used on the site:

  • Product in stock at Abstract Lab: indicated delay of 2 to 5 days These deadlines apply to metropolitan France. For other areas, the corresponding differential must be added to the delivery time difference announced by the carrier. Abstract Lab undertakes to show diligence in the preparation and dispatch of packages.

D- CUSTOMER RECEIPT

I – DELIVERY METHOD

For deliveries, conventional courier companies have been chosen. Most packages will be transported by La Poste or TNT. The delivery of products will be made to the address provided by the customer during the order. The customer has the option to request delivery to a nearby parcel shop in the “comments” section of the order form. In this case, the carrier will not deliver to the specified address but will choose the nearest parcel shop and then inform the customer of the address where they can collect the package.

II – HOURS

Packages are delivered between 8:30 AM and 6:30 PM from Monday to Friday.

III – INFORMATION REQUIRED FOR DELIVERY

The delivery of the package on the first attempt is a time and money saver for all stakeholders in the chain: Abstract Lab, the carrier, and the customer. To allow first-attempt delivery under the best conditions, please specify any useful information regarding the delivery address and the recipient’s availability in the “comments” section of the order form: days of absence, unavailable time slots, access code, doorbell name, etc. If you work during the week, it is highly recommended to provide your business address as the delivery address to avoid multiple delivery failures. Most packages will not fit in your mailbox.

IV – PACKAGE RECEIPT

The customer is required to check the good condition of the package upon delivery. In case of missing or damaged items, the customer must make reservations with the carrier at the time of delivery or the representative of the post office or the parcel shop if applicable. These reservations must be recorded on the delivery slip. Therefore, it is essential not to leave before opening and checking the contents of the package.

Subsequently, contact us at abstract.distillery@gmail.com, specifying your contact details, order number, and the nature of the problem to arrange for a new delivery. In the case of the customer’s repeated absence during delivery or non-retrieval of parcels left at the post office or parcel shop, any return costs of products to Abstract Lab and the re-shipping of the order are the responsibility of the customer. Any potential delay in delivery compared to the deadlines indicated in these general terms does not entitle the customer to damages from Abstract Lab. Abstract Lab is relieved of its obligation to deliver in case of force majeure such as war, riot, fire, strike, accident, natural disaster, or inability to source from a supplier.

E- Delivery Rates

The customer’s delivery cost may vary depending on the geographic area, delivery time, time slots, as well as the weight or value of the ordered items. The delivery costs remain constant for the same order regardless of the number of items ordered. For example, if you place an order with 3 items for metropolitan France in non-urgent shipping, you will pay a total shipping fee of €15 for the 3 items. Here are the main cases:

  • Standard Metropolitan France: €15 incl. VAT
  • Corsica < 3 kg: €15 incl. VAT
  • Overseas Departments (DOM) < 3 kg: €15 incl. VAT
  • Overseas Territories (TOM) < 3 kg: €15 incl. VAT
  • Other countries < 3 kg: €15 incl. VAT
  • Customer pickup at the Abstract Lab store: €0.00 incl. VAT

For other cases, please send a quote request to abstract.distillery@gmail.com. In these cases, the minimum shipping cost is €15 incl. VAT, excluding metropolitan France and the TOM. For orders exceeding €100 incl. VAT in metropolitan France, shipping costs are waived. In all other cases, corresponding shipping costs must be selected and paid with the order. If the customer omits to select the corresponding shipping costs or chooses a category that does not correspond to the reality of their order, Abstract Lab reserves the right to delay delivery or even cancel the order. Shipping costs are subject to change, especially based on the evolving rates of courier companies.

7. Payment

The product prices are payable in cash on the day of the effective order. This price is indicated on the order confirmation sent to the customer by Abstract Lab. Payment can be made by:

  • Credit card: Visa, EuroCard, MasterCard, CB The secure Monetico Paiement system from CIC is used by the www.abstract-lab.art site. The personal information that customers are required to provide is perfectly protected and encrypted before transmission to the processing center. A customer’s order will be considered effective only when the payment center has given its approval. In case of refusal by Monetico Paiement, the order will be automatically canceled. Abstract Lab will notify the concerned customer by email.

Check made out to Abstract Lab: After selecting this payment method, the customer sends a letter specifying the order number with a check corresponding to the total amount of the order and shipping costs to Abstract Lab – 2 rue Duroc, 69001 Lyon (payment address). Abstract Lab will promptly prepare and ship the order after endorsing the check (an average delay of 2 working days after receipt). If there is a blatant inconsistency between the selected fees and the delivery address or the weight of the package, the order will not be shipped.

8. Promotions, Discounts, Loyalty

Abstract Lab may grant discounts to its customers on all or part of the catalog. Discounts are granted relative to the displayed price (not struck out). Therefore, in the case of a struck-out price, the discounts apply to the already discounted price on the site. Catalog prices are subject to change without notice, especially in the case of input errors. Types of discounts:

  • Discount granted to a group of people (e.g., members of a tennis club): in this case, members receive a gift voucher to be entered during the order or are assigned to a group that benefits from the discount. In this case, proof may be requested for group registration, and a simple procedure will be communicated to its members through the responsible person.
  • Discount granted to an individual: anyone who has accumulated a certain amount of gross purchases on the www.abstract-lab.art site is eligible to receive gift vouchers or additional discounts valid on the entire site. Gift vouchers are deducted from the displayed prices.

The data recorded by the Abstract Lab computer system constitutes proof of all transactions between Abstract Lab and its customers.

9. Product Returns

The customer has 7 clear days from the delivery date (Article L 121-16 of the Consumer Code) to return an item. Abstract Lab commits to exchange the item, issue a credit, or refund it without any specific reason, provided that it is returned unused and intact in its original packaging. The customer must obtain a duplicate of the “Return Receipt” from the carrier. If Abstract Lab is not responsible for the reason for the return (delivery in accordance with the order), return costs will be borne by the customer and deducted from the credit or refund or invoiced for an exchange. If Abstract Lab is responsible (delivery different from the order), these costs will be covered by Abstract Lab. Items returned incomplete, damaged, or soiled by the customer are not accepted. 10. Liability

The products offered comply with current French legislation. Photographs and texts reproduced and illustrating the presented products are not contractual. Therefore, Abstract Lab’s liability cannot be engaged in the event of an error in one of these photographs or texts. Abstract Lab cannot be held responsible for the non-performance of the contract in the event of stockout or unavailability of the product, in case of force majeure, disruption or total or partial strike, especially postal services and means of transport and/or communications, flood, fire, disaster. Hypertext links may refer to sites other than the www.abstract-lab.art site. Abstract Lab disclaims all responsibility in case the content of these sites violates current legal and regulatory provisions. In addition, the customer undertakes to respect the conditions and precautions for using the products, especially if stipulated in the instructions or packaging, or on the product sheets of the www.abstract-lab.art site. Abstract Lab cannot be held responsible for damages of any kind that may result from the misuse of the items delivered to the customer. Abstract Lab cannot be held responsible for any changes made by manufacturers and/or suppliers to the composition of the items sold on the www.abstract-lab.art site. In any case, Abstract Lab’s liability will be limited to the amount of the order.

11. Applicable Law and Disputes

This contract is subject to French law. The language of this contract is English. In case of a dispute regarding its interpretation and/or execution, the Lyon Commercial Court will be the sole competent authority. The customer and Abstract Lab will always prefer an amicable solution before any legal action. In accordance with Articles 313-1 and following of the Penal Code, committing fraud is defined as “the act, either by using a false name or false quality, or by abusing a true quality, or by using fraudulent maneuvers, to deceive a natural or legal person and induce them, to their own detriment or to the detriment of a third party, to hand over funds, valuables, or any property, to provide a service, or to agree to an act creating an obligation or discharge.” The crime of fraud through fraudulent use of a means of payment can result in a penalty of 5 years of imprisonment and a fine of €400,000. Attempting fraud carries the same penalties. Our site’s policy is to prosecute criminally anyone found guilty of such fraud attempts. We will not hesitate to file a complaint, especially based on the information provided during online orders (IP address, name, first name, or delivery details).

12. Protection of Personal Data

The personal information collected from the customer is essential for processing the order, shipping the order, and preparing the corresponding invoice. Failure to provide such information will result in the refusal of the order. To comply with the “Informatique et Libertés” law, the processing of personal information related to customers has been declared by Abstract Lab to the Commission Nationale de l’Informatique et des Libertés (CNIL).
